Who should we call? Horrible injury at Target.?
My brother has his own truck business and was delivering a pallet of water at a Target store and was hurt very badly. The pallet jack he was using, broke apart and slammed into his legs, with the pallet of water on it. All 2500 pounds of it. He was on the floor in the shipping part of the store for 30-45 minutes before someone found him. He was then rushed to to ER were the doctors said he had completely torn the quadriceps in both legs. He had emergency surgery the next day. He’s not paralyzed, but cannot walk. He uses a wheelchair and a walker. He cannot bend his legs because both of his legs have about 30 staples in them. Since he was delivering out of state and lives in another state, who does he need contact regarding getting his medical bills paid? Pain and suffering?
He should have workers’ compensation on his business if he has any other employees. That should cover his injuries. After that, his health insurance. If he, inexplicably, doesn’t have either, he has to pay his own bills and then get help from the government. (Another reason for government health care.) Neither pay for pain and suffering, only medical bills and for WC, disability. Does he have insurance on his business? There might be something there.
If he can show that the pallet jack was defective or poorly maintained, he can sue the maker or Target if it was their jack. The problem is, since he was alone, they might say he was using it wrong. In any case, there would be no money until he is all better, if he could get a settlement.
